Terms and Conditions of the Online Store iskratool.com

These Terms and Conditions have been prepared in accordance with the Act of 18 July 2002 on the provision of electronic services (Journal of Laws of 2002, No. 144, item 1204, as amended).
The owner and operator of the online store available at www.iskratool.com is Iskra Krzysztof Brzeziński (Tax ID: PL7731002589), based in Tomaszów Mazowiecki, Poland, at ul. Legionów 20, hereinafter referred to as ISKRA.
Definitions: 
• Customer: Any person over 18 years of age or legal entity making a purchase through the online store.
• Goods: Products listed as “available” on www.iskratool.com.
• Sales Agreement: An agreement for the sale of goods concluded between ISKRA and the Customer via the online store.
• Online Store: The website accessible at www.iskratool.com.
• Order: A declaration of intent by the Customer, specifying the product type and quantity, leading to a Sales Agreement.

1. General Provisions

1.1. These Terms define the rules for using the online store at www.iskratool.com.
1.2. Specifically, they govern:
• Order placement and processing procedures;
• Terms of the Sales Agreement;
• Complaints procedure.
1.3. The store is intended for customers over 18 years of age. International orders are accepted.
1.4. The Terms are available at all times via the homepage and can be downloaded or printed.

2. Use of the Online Store

2.1. Customers can place orders exclusively without creating a user account – as guest checkout only. To process an order, the following are required:
• acceptance of these Terms and Conditions,
• accurate personal information necessary for order fulfillment (such as full name, shipping address, email address, phone number, and – for business customers – invoicing details).
2.2. ISKRA may block a Customer’s account if they:
• Provided false or misleading data during registration;
• Use the store for purposes other than purchasing goods;
• Act in violation of applicable law or the rights of ISKRA.

3. Conclusion of the Sales Agreement

3.1. To conclude a sales contract, the Customer must place an order via the store interface and confirm payment.
3.2. Orders may also be placed by sending an email to info@iskratool.com with detailed product and shipping information.
3.3. Payment methods accepted: PayPal, GPay. Orders are processed upon confirmation of payment.
3.4. Full delivery details are required for order processing. For VAT invoices, customers must provide company name, address, tax ID, and contact number.
3.5. Acceptance of the Terms is mandatory for completing a purchase.
3.6. All prices displayed on the Online Store include VAT (where applicable) and are shown in the currency relevant to the user’s location. The applicable VAT rate is determined based on the delivery country and/or the buyer’s billing details.
3.6a. For customers located within the European Union, VAT will be charged according to the rules of the destination country. If the buyer is a VAT-registered business entity from the EU (excluding Poland) and provides a valid EU VAT ID, the order may qualify for VAT exemption (0%) under the reverse charge mechanism. The VAT number is automatically verified via the EU VIES system.
3.6b. For customers outside the EU, prices are shown without VAT, but local import taxes or customs duties may apply depending on the destination country. These charges are the responsibility of the buyer.
3.6c. Automatic location detection (via IP address) may be used to suggest currency and applicable tax rate during the shopping process. However, the final VAT amount will always be based on the country selected in the billing and shipping address fields at checkout.
3.7. Customers will receive order confirmation via email. In case of product unavailability, alternative delivery dates will be provided.

4. Shipping

4.1. ISKRA ships internationally using DPD (mainly Europe) and FedEx (Europe and worldwide). Shipping costs are indicated during checkout.
4.2. Orders are shipped within 5 business days.
4.3. Customers cover full shipping costs.
4.4. ISKRA is not liable for delays caused by courier services or customer-related issues.

5. Right of Withdrawal

5.1. Customers (within the EU) have the right to withdraw from a distance contract within 14 days without giving any reason.
5.2. The withdrawal period begins on the day the Customer receives the Goods.
5.3. Exceptions to the right of withdrawal:
• Customized or made-to-order products;
• Perishable goods.
5.4. Upon withdrawal, both parties must return what was exchanged. The product must be returned in original condition within 14 days from the date the Customer notifies ISKRA of withdrawal.
5.5. Return shipping costs are borne by the Customer.
5.6. In the event of order cancellation or withdrawal after payment has been processed, ISKRA reserves the right to reimburse the payment amount reduced by the non-refundable transaction fees charged by the payment service provider (e.g., PayPal). These fees are typically non-recoverable by ISKRA Customers will be made aware of this deduction prior to the refund being issued.

6. Complaints

6.1. Complaints will be processed in accordance with Polish Civil Code provisions.
6.2. Customers are advised to check shipments upon receipt and, if damaged, request a report from the courier.
6.3. The complaint should include a copy of the purchase invoice.
6.4. Complaints should contain Customer contact details and a clear description of the defect.
6.5. The Customer bears the cost of shipping the item subject to the complaint.

7. Personal Data Protection

7.1. By accepting the Terms, the Customer consents to the processing of their personal data solely for order fulfillment purposes.
7.2. Data is stored securely and not shared with third parties. Customers have the right to access, correct, and request the removal of their data.

8. Final Provisions

8.1. These Terms apply to all orders, regardless of how they are placed.
8.2. ISKRA reserves the right to modify the Terms. Changes do not affect orders already accepted.
8.3. Disputes with consumers will be resolved in accordance with applicable civil procedure rules.
8.4. Disputes with non-consumers will be resolved in the court competent for ISKRA’s registered office.
8.5. Matters not covered by these Terms shall be governed by Polish law.

9. VAT and Tax Compliance

9.1. The Online Store uses automated systems to determine the buyer’s country of residence and applicable VAT rate. This may include analyzing your IP address or selected country at checkout.
9.2. We use VAT validation tools, including access to the EU VIES database, to verify the eligibility for VAT exemption for business customers within the European Union.
9.3. If any discrepancies are detected between your IP location and provided billing country, we may request additional documentation to validate the correct tax treatment of the transaction.
9.4. All tax rules are applied in compliance with:

• The EU VAT Directive (2006/112/EC),
• Applicable local tax laws in the buyer’s country,
• The Polish VAT Act for domestic and export sales.

Right of Withdrawal Information You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period begins on the day you receive the goods. To exercise the right of withdrawal, you must notify ISKRA at ul. Legionów 20, 97-200 Tomaszów Mazowiecki, Poland or by email at info@iskratool.com.

If you withdraw from the contract, we shall reimburse all payments received from you, including delivery costs (except additional costs for delivery options other than the least expensive standard delivery offered by us), no later than 14 days from receiving your withdrawal notice. Reimbursement will be made using the same payment method you used, unless expressly agreed otherwise. You will not incur any fees for such reimbursement.

You must return the goods to the address above without undue delay and in any event no later than 14 days from the date on which you notify us of your withdrawal. Return shipping costs are borne by you.
